Terms of Service

Welcome to WhisperGuide. These Terms of Service (“Terms”) are a legal agreement between you and WhisperGuide, Inc. (“WhisperGuide,” “we,” “us,” or “our”). They govern your use of the WhisperGuide mobile application, website, content, features, subscriptions, purchases, and related services collectively referred to as the “Service.”

By creating an account, downloading the app, tapping “I Agree,” purchasing access, or using the Service in any way, you agree to these Terms. If you do not agree, do not use WhisperGuide.

These Terms incorporate by reference our Privacy Policy, Legal Disclaimer and Safety Notice, Subscription and Purchase Terms, and Account and Data Deletion Policy.

1. Who Can Use WhisperGuide

You must be at least 13 years old to use WhisperGuide. If you are under 18, you may use the Service only with the involvement and permission of a parent or legal guardian.

By using WhisperGuide, you confirm that the information you provide is accurate and that you are legally permitted to enter into this agreement.

2. Your Account

To use most features of WhisperGuide, you may need to create an account. You agree to:

  • provide accurate and complete information when signing up;

  • keep your password and login credentials secure;

  • not share your account with others;

  • take responsibility for activity under your account;

  • notify us promptly at support@whisper-guide.com if you suspect unauthorized use of your account.

You may delete your account through the in-app account deletion feature or by following the instructions in our Account and Data Deletion Policy.

Deleting the app from your device does not automatically delete your account or cancel any subscription purchased through Apple App Store or Google Play.

3. How WhisperGuide Works

WhisperGuide is a location-based audio storytelling app. The Service may allow users to:

  • select story categories, including History, Architecture, Culture, Food & Drink, Nature, and Legends;

  • use device location to discover nearby points of interest;

  • read AI-generated story cards;

  • listen to AI-generated audio stories;

  • explore places freely on a map;

  • follow themed routes where available;

  • save or favorite selected places or routes.

Features, categories, content, routes, pricing, and availability may change over time.

WhisperGuide is intended for casual walking exploration and entertainment. It is not an official guide, navigation system, safety tool, emergency service, or professional advice service.

4. AI-Generated Content

WhisperGuide uses artificial intelligence and related technologies to generate, assist, or support storytelling content, including written stories, descriptions, recommendations, routes, and audio narration.

Because content may be generated by AI or based on third-party or publicly available information:

  • stories may contain inaccuracies, omissions, fictionalized elements, outdated information, or unverified details;

  • names, dates, descriptions, business details, historical details, cultural interpretations, accessibility information, directions, and hours of operation may be incorrect;

  • stories may include folklore, legends, rumors, local traditions, or narrative elements presented for storytelling purposes;

  • content should be enjoyed as informational and entertainment content, not as authoritative reference material.

WhisperGuide is not an official source of historical, cultural, travel, safety, legal, medical, emergency, accessibility, navigation, or business information.

You should independently verify important information before relying on it.

We welcome correction requests or feedback at support@whisper-guide.com, but we do not guarantee that any correction will be made.

5. Safety and User Responsibility

You are solely responsible for your own safety, surroundings, travel decisions, route choices, and actions while using WhisperGuide.

You agree to:

  • stay aware of your surroundings;

  • obey all laws, traffic rules, posted signs, and official instructions;

  • respect private property, restricted areas, business rules, and access limitations;

  • use reasonable judgment before visiting or entering any location;

  • verify hours, access, safety conditions, fees, accessibility, transit information, and other practical details independently;

  • avoid using the app in a way that distracts you while walking, biking, driving, crossing streets, or doing anything that requires attention.

WhisperGuide is not designed or intended for use while driving or operating any vehicle. Do not use the app while driving unless you are parked or the app is being operated safely and legally by a passenger or through permitted hands-free use.

Do not trespass, enter unsafe areas, ignore posted warnings, or rely on WhisperGuide for emergency, safety, navigation, crime, weather, health, legal, or official instructions.

6. Free Access, Passes, Subscriptions, and Payment

WhisperGuide may offer free access, day passes, subscriptions, promotional access, or other paid features.

At launch, WhisperGuide may offer:

  • Free access to a limited number of story experiences and 1 free route;

  • 1-Day Pass;

  • 3-Day Pass;

  • 7-Day Pass;

  • Monthly Subscription.

The exact pricing, access period, features, limitations, and renewal terms will be shown in the app or on the purchase screen before you complete a purchase.

Free access does not require a payment method and does not automatically convert into a paid subscription.

Day passes are one-time purchases and do not automatically renew.

The Monthly Subscription is an auto-renewing subscription. It renews automatically unless canceled through your Apple App Store or Google Play account settings before the renewal deadline shown by the applicable store.

All purchases are processed by Apple App Store, Google Play, or another authorized payment provider. WhisperGuide does not receive or store your full payment card details.

Cancellation of a subscription stops future renewals but does not usually provide a refund for the current billing period. You will generally keep access until the end of the period already paid for, subject to Apple, Google, or applicable payment platform rules.

Refunds are handled by Apple, Google, or the applicable payment provider according to their policies and applicable law. WhisperGuide cannot directly issue refunds for purchases processed by Apple App Store or Google Play.

We may change prices or available plans from time to time. Price changes for auto-renewing subscriptions will be handled according to the rules of the applicable app store or payment provider.

7. Acceptable Use

You agree not to:

  • use the Service for any unlawful, harmful, fraudulent, abusive, or unauthorized purpose;

  • violate any local, state, national, or international law;

  • use the Service in a way that endangers yourself or others;

  • copy, scrape, reproduce, redistribute, resell, or commercially exploit stories, audio narration, images, route designs, app content, or other Service materials without our written permission;

  • reverse-engineer, decompile, modify, or attempt to extract source code from the app or Service;

  • bypass, disable, or interfere with security features, access controls, paid-tier restrictions, usage limits, or technical protections;

  • use bots, scrapers, scripts, automated tools, or other non-human access methods without our written permission;

  • interfere with, overload, disrupt, or damage the Service or related infrastructure;

  • impersonate another person or misrepresent your identity;

  • infringe or violate intellectual property, privacy, publicity, or other rights;

  • use the Service to harass, threaten, defame, harm, or exploit others.

We may suspend or terminate access if we believe you have violated these Terms or used the Service in a harmful, unlawful, abusive, or unauthorized way.

8. Intellectual Property and Content Ownership

The WhisperGuide app, website, name, logo, branding, interface, software, story text, audio narration, route designs, categories, prompts, compilations, and related materials are owned by or licensed to WhisperGuide, Inc. and are protected by copyright, trademark, trade secret, and other intellectual property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to use the Service for your personal, non-commercial use.

You do not acquire ownership rights in the Service or its content.

9. Third-Party Content and Services

WhisperGuide may rely on or display content, data, maps, images, location information, business information, public records, or other materials from third-party services or public sources.

Examples may include maps, places data, AI providers, audio providers, hosting providers, analytics providers, payment processors, public data sources, image sources, and other third-party services.

Third-party content and services remain subject to their own terms, policies, licenses, and rights. WhisperGuide does not control and is not responsible for third-party content, services, availability, accuracy, safety, legality, or performance.

References to third-party businesses, landmarks, venues, routes, neighborhoods, websites, or services do not mean that WhisperGuide endorses, sponsors, verifies, or is affiliated with them.

10. Feedback and User Communications

If you send us feedback, suggestions, corrections, ideas, reports, or other communications, you allow WhisperGuide to use them to operate, improve, market, and develop the Service without compensation to you.

You are responsible for any information, images, messages, or materials you choose to send to us. Do not send content that you do not have the right to share.

11. No Guarantee of Accuracy or Availability

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, WhisperGuide disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, security, and uninterrupted operation.

We do not guarantee that:

  • the Service will always be available, secure, uninterrupted, or error-free;

  • stories, routes, locations, maps, audio, images, or recommendations will be accurate, complete, current, reliable, or suitable for your situation;

  • any point of interest, business, venue, route, or location will be open, accessible, safe, legal to enter, or suitable to visit;

  • any AI-generated content will be factual, complete, unbiased, or up to date;

  • bugs or errors will be corrected.

Your use of WhisperGuide is at your own discretion and risk.

12. Limitation of Liability

To the maximum extent permitted by law, WhisperGuide, Inc. and its owners, officers, directors, employees, contractors, developers, agents, partners, licensors, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or other intangible losses arising out of or related to:

  • your use of or inability to use the Service;

  • AI-generated, inaccurate, incomplete, fictionalized, outdated, misleading, or unavailable content;

  • any decision or action you take based on the Service;

  • your visit to, avoidance of, or interaction with any location, business, route, venue, landmark, or point of interest;

  • personal injury, property damage, travel disruption, financial loss, delay, inconvenience, or other consequences related to use of the Service;

  • unauthorized access to or use of your account;

  • third-party content, services, websites, platforms, providers, businesses, or locations;

  • app errors, outages, interruptions, security incidents, or data loss.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of:

(a) the amount you paid to WhisperGuide through the Service in the twelve months before the claim arose; or
(b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless WhisperGuide, Inc. and its owners, officers, directors, employees, contractors, developers, agents, partners, licensors, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your use or misuse of the Service;

  • your violation of these Terms;

  • your violation of any law or regulation;

  • your violation of any third-party right, including intellectual property, privacy, publicity, or property rights;

  • your unsafe, unlawful, or unauthorized conduct while using the Service.

14. Suspension, Termination, and Service Changes

You may stop using WhisperGuide at any time. You may also delete your account through the in-app account deletion feature or by following our Account and Data Deletion Policy.

We may suspend, restrict, or terminate your access to the Service, with or without notice, if we believe:

  • you violated these Terms;

  • your account is being used fraudulently, unlawfully, abusively, or insecurely;

  • continued access may create legal, safety, security, operational, or reputational risk;

  • we are required to do so by law;

  • we discontinue or materially change the Service.

We may modify, suspend, discontinue, or remove any part of the Service at any time, subject to applicable law.

If your account is terminated because of your violation of these Terms, you are not entitled to a refund of any fees already paid, except where required by applicable law or by the policies of Apple, Google, or another payment provider.

15. Privacy

Our Privacy Policy explains how we collect, use, share, retain, and protect personal information.

By using WhisperGuide, you acknowledge our Privacy Policy.

16. Account and Data Deletion

If you create a WhisperGuide account, you may initiate account deletion inside the app.

Deleting your account will delete or de-identify personal information associated with your account, except information that we are legally required or permitted to retain for legal, tax, accounting, security, fraud-prevention, dispute-resolution, or compliance reasons.

Deleting your account does not automatically cancel subscriptions purchased through Apple App Store or Google Play. You must cancel those subscriptions through your Apple or Google account settings.

17. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the effective date or “Last updated” date.

If changes are material, we may notify users through the app, website, email, or another reasonable method.

Your continued use of WhisperGuide after updated Terms become effective means you accept the updated Terms. If you do not agree, stop using the Service and delete your account.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles.

Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, unless applicable law requires otherwise.

You consent to the personal jurisdiction and venue of those courts.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
