Terms of Service

Welcome to WhisperGuide. These Terms of Service ("Terms") are a legal agreement between you and WhisperGuide, Inc. ("WhisperGuide," "we," "us," or "our"). They govern your use of the WhisperGuide mobile app and the website at www.whisper-guide.com (together, the "Service").
By creating an account, downloading the app, or using the Service in any way, you agree to these Terms. If you do not agree, please do not use the Service.

1. Who can use WhisperGuide
You must be at least 13 years old to use WhisperGuide. If you are under 18, you may only use the Service with the involvement of a parent or guardian.
By using WhisperGuide, you confirm that the information you provide is accurate and that you are legally permitted to enter into this agreement.
2. Your account
To use most features of WhisperGuide, you'll need to create an account. You agree to:
Provide accurate and complete information when signing up.
Keep your password secure and not share it with anyone.
Take responsibility for everything that happens under your account.
Notify us promptly at support@whisper-guide.com if you suspect unauthorized use of your account.
You may delete your account at any time. See our Account & Data Deletion page for instructions.
3. How WhisperGuide works
WhisperGuide is a location-based audio storytelling app. When you open the app:
You select one or more story categories (History, Architecture, Food & Drink, Local Life, Nature, Legends).
The app uses your device location to find nearby points of interest.
You can tap a place on the map to read a story card and listen to an AI-generated audio story (Free Navigation), or follow a curated themed route where stories activate as you walk (Themed Routes).
WhisperGuide is intended for walking exploration. The Service is not designed or intended for use while driving or operating any vehicle. You agree to use WhisperGuide safely and to follow all local laws, traffic rules, posted signs, and real-world conditions.
4. AI-generated content
WhisperGuide uses artificial intelligence to research and generate the storytelling content you hear in the app, including written stories and audio narration. This is core to how the Service works.
Because the content is AI-generated:
Stories may contain inaccuracies, omissions, or outdated information.
Names, dates, descriptions, and historical details may not always be correct.
Stories should be enjoyed as storytelling and entertainment, not as authoritative reference material.
WhisperGuide is a travel and discovery companion, not an official source of historical, legal, safety, navigation, or emergency information. Do not rely on WhisperGuide for any purpose where accuracy matters in a critical way (for example, legal decisions, medical decisions, navigation in dangerous terrain, or emergency situations).
We work to keep stories grounded and useful, and we welcome corrections at support@whisper-guide.com.
5. Subscriptions, passes, and payment
WhisperGuide offers a free tier and several paid options:
Free — 10 story plays and 1 generated route.
1-Day Pass — $6.99, one-time purchase.
3-Day Pass — $14.99, one-time purchase.
7-Day Pass — $24.99, one-time purchase.
Monthly Subscription — $49.99 per month, auto-renews until cancelled.

Auto-renewal (Monthly Subscription)
The Monthly Subscription automatically renews at $49.99 per month unless cancelled at least 24 hours before the end of the current billing period. Day passes do not auto-renew.
Billing and payment
All purchases are processed through Apple App Store or Google Play, depending on your device. WhisperGuide does not receive or store your payment details.
Cancellation
You can cancel a Monthly Subscription at any time through your Apple ID or Google Play account settings. Cancellation stops future renewals — you keep access until the end of the period you've already paid for.
Refunds
Refunds for in-app purchases are handled by Apple or Google according to their refund policies. WhisperGuide cannot process refunds directly.
Price changes
We may change prices for new purchases at any time. We will not change the price of a pass or subscription you have already bought. If we change the price of the Monthly Subscription, we will notify existing subscribers in advance and you can cancel before the new price takes effect.
6. Acceptable use
When using WhisperGuide, you agree not to:
Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
Reverse-engineer, decompile, or attempt to extract the source code of the app.
Copy, scrape, or redistribute story content, audio narration, images, or other Service content for commercial use without our written permission.
Use the Service to harass, harm, or impersonate any other person.
Interfere with the operation of the Service, including by attempting to bypass rate limits, security measures, or paid-tier restrictions.
Use automated tools (bots, scrapers, scripts) to access the Service.
Use the Service in any way that could damage, disable, overburden, or impair our infrastructure.
We may suspend or terminate your account if you violate these rules.
7. Content ownership
Our content
The WhisperGuide app, website, branding, story text, audio narration, route designs, and other Service content (other than third-party content noted below) are owned by WhisperGuide, Inc. and protected by copyright, trademark, and other intellectual property laws.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment. You do not acquire any ownership rights in the Service or its content.
Third-party content
WhisperGuide displays content from third-party sources, including images from Wikimedia Commons (used under Creative Commons or public-domain licenses) and information from Wikidata and OpenStreetMap. These remain the property of their respective contributors and are subject to their own license terms.
8. No guarantee of accuracy or availability
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
Warranties of merchantability, fitness for a particular purpose, and non-infringement.
Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Warranties that any content (including AI-generated stories) is accurate, complete, current, or reliable.
Your use of WhisperGuide is at your own discretion and risk.
9. Limitation of liability
To the maximum extent permitted by law, WhisperGuide, Inc. and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from or related to:
Your use or inability to use the Service.
Any content provided through the Service, including AI-generated stories.
Any decision or action you take based on Service content.
Any unauthorized access to or use of your account.
In all cases, our total liability to you for any claim related to the Service shall not exceed the greater of (a) the amount you have paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
10. Indemnification
You agree to defend, indemnify, and hold harmless WhisperGuide, Inc. and its officers, employees, and agents from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys' fees) arising out of:
Your use of the Service.
Your violation of these Terms.
Your violation of any third-party right, including intellectual property or privacy rights.
11. Termination
You can stop using WhisperGuide at any time and delete your account through the Account & Data Deletion process.
We may suspend or terminate your access to the Service, with or without notice, if we believe you have violated these Terms, if required by law, or if continued operation becomes impractical. We may also discontinue the Service entirely.
If your account is terminated for violating these Terms, you are not entitled to a refund of any pass or subscription fees already paid.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where appropriate, notify users in the app or by email.
Your continued use of the Service after changes take effect means you accept the updated Terms. If you do not agree to the changes, please stop using the Service and delete your account.
13. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles.
Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
If any part of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
